By completing an online transaction with us, you have affirmed that you have read, understood, and agreed to the Tumblin4kids.com Terms of Service (TOS). If you do not agree to the TOS, then do not complete your transaction with us. (Please contact us with your questions about the TOS.) The purpose of our TOS Agreement is to establish expectations and reveal our mutual rights and obligations in open, plain language so that we may deal confidently with you and you with us.
Payments is due at the time of purchase. Although we utilize encryption security services, you shall hold us blameless in the unlikely event your personal data is stolen by a third party.
PRICING AND FEES:
Tumblin4kids.com reserves the right to adjust prices in relation to its business objectives. Price changes are effective the moment they are published to the site.
*SUSPENSION / CANCELLATION OF ORDERS:
At all times and without limitation Tumblin4kidss.com reserves the right to suspend or cancel a pending order (orders that have not cleared). Reasons for doing so are broad, but include:
- Item is no longer available to Tumblin4kids.com.
- The item is held up in order-pending status because the supplier needs to correct or update a product.
- Tumblin4kids.com is unable, for any reason, to fulfill the order satisfactorily, and does not wish to process a problematic order.
- Any other reason that Tumblin4kids.com determines appropriate to its business needs.
RETURNS / REFUNDS:
- Wrong items shipped
- Substantially Incorrect in the Description
- Shipped more than 5 days passed the 72 hour shipping promise.
- Delivery delayed more than 5 days passed the 72 hour guarantee because the item was shipped to an incorrect address.
- Item delivered damaged.
In all cases, the Tumblin4kids.com RMA agent will review the RMA Request Form submitted by the customer within 10 days of delivery date, and will render a judgment regarding the approval or denial of the request. You agree to accept the determination of the RMA agent as sufficient and final when you agree to purchase an item from Tumblin4kids.com.
IF YOU SEE DAMAGE in the packaging of the item when it is delivered, you must (1) note the damage in detail on the shipping document before releasing the courier, and (2) open the package with the courier present. You are also permitted to refuse shipment if the item is damaged to the point that you do not want it. If you refuse shipment, you should call or email Tumblin4kids.com asap; this is to ensure that you receive a full refund via the RMA process. In this rare case, we will issue a tentative RMA#, which need not be on the returned package. Our final decision will be made regarding a refund when the returned item is inspected by our representative.
SHIPPING (Merchandise Orders):
An order is not a completed order until payment has cleared and no items shall ship until then. We guarantee shipment within 72 hours once (1) payment has cleared, (2) we have a valid shipping address from you and items are ready to be sent. All Tumblin’ Wear items are made per order.
IMPORTANT: See “IF YOU SEE DAMAGE”, under RETURNS/REFUNDS, above, to properly handle damaged deliverables.
The court of jurisdiction in all and any disputes, unless otherwise agreed to in writing, shall be in the State of Ohio, County of Franklin. Any part of this Agreement that is adjudicated by a Court of proper Jurisdiction to be unenforceable within the law, shall not, per se, impair or render the remaining parts of this Agreement null or void.
To comply with changes in law, or for any reason deemed appropriate by .com, Tumblin4kids.com we shall freely revise this agreement without limit. Revisions are merely prospective in nature, and will not affect past sales.
